Gabriela Rosas Santa Rosa: Gabriela Rosas Injured In Santa Rosa Car Accident By West Eighth Street By North Dutton Avenue

SANTA ROSA, CALIFORNIA (September 9, 2019) – A 20-year-old woman identified as Gabriela Rosas was seriously injured in a car accident by the intersection of West Eighth Street and North Dutton Avenue. 

Gabriela Rosas was in the middle of the intersection and another car stopped for her. Santa Rosa police are saying that a teenage driver was approaching the intersection as well around 7:45 p.m. while on a FaceTime call. 

That driver didn’t realize that Gabriela Rosas was in the crosswalk and collided with her without braking. The victim was thrown into the air and landed on the asphalt. 

Paramedics rushed to the scene in order to help the victim. Gabriela Rosas was hospitalized with a traumatic head injury and several broken bones. 

An investigation into the Santa Rosa pedestrian accident remains ongoing.  

Driver Liability In Pedestrian Accidents

Every driver in California must yield the right of way to pedestrians that are in lawfully marked crosswalks. According to California Vehicle Code 21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.” Pedestrian accidents tend to happen when drivers are:

California law forbids drivers from using cellphones while operating a motor vehicle. According to California Vehicle Code 23123, “A person shall not drive a motor vehicle while using a wireless telephone unless that telephone is specifically designed and configured to allow hands-free listening and talking, and is used in that manner while driving.” Depending on the facts of any case a city could even be held liable for an accident. 

Cities have a legal responsibility to design, construct and maintain roads that are in a reasonably safe condition. If an intersection lacks adequate safety features like stop signs or street lights it could be dangerous.
