California Highway Patrol are saying that the accident took place shortly after 10:00 p.m. It all started when the driver of a 2015 Honda Odyssey was attempting to make a left onto Highway 41.

A Ford Pickup truck carrying Federico Lopez Torres and Juan Silva Casares were headed in the opposite direction when the two vehicles collided. Juan Silva Casares later died following the car accident.

Liability In Head-On Collisions

According to to ASIRT, “Nearly 1.25 million people die in road crashes each year, on average 3,287 deaths a day. An additional 20-50 million are injured or disabled. More than half of all road traffic deaths occur among young adults ages 15-44.” Head-on crashes in particular are among the most dangerous types of crashes that a person can be involved in. Many accidents happen as drivers make dangerous left turns.

Drivers that are attempting to make a left turn must first yield the right of way to any vehicle or pedestrian that is close enough to pose a hazard. According to California Vehicle Code 21801, “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement.”

The family of any victim that died in an accident may have legal recourse through California Code of Civil Procedure 377.60. Damages can help cover lost wages, medical bills and pain and suffering. It’s important that victims also get medical treatment as quickly as possible. Failing to seek medical care could possibly jeopardize your ability to file a claim down the line. A car accident attorney can examine all of the facts of your case and let you know what your rights are.
