Liability In Pedestrian Accidents

All drivers have a responsibility to keep an eye out for pedestrians and to yield the right of way at legally marked crosswalks. According to California Vehicle Code 21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.” But even if a pedestrian is jaywalking or otherwise in the middle of the road, drivers must still exercise caution in order to avoid hitting them.

On certain occasions, there may be contributing factors to a pedestrian accident beyond driver error. A number of pedestrians are killed or seriously injured every year on dangerous roads or intersections. Some intersections lack adequate lighting and thus make it difficult to see pedestrians. Some intersections may have stop signs or lights that are obscured by foliage. Cities may be held liable for accidents caused by defects at intersections.

Any person that loses a loved one in a pedestrian accident may have legal recourse through California Code of Civil Procedure 377.60. Damages in a civil claim can help cover a variety of costs incurred from an accident. This may include funeral expenses, lost wages, medical bills and emotional trauma. A wrongful death attorney can investigate your claim free of cost and get to the bottom of what happened.
