Elvira Zuniga Valencia Madera – Maria Gonzalez Madera: Elvira Zuniga Valencia Killled, Maria Barajas Gonzalez Injured In Madera Truck Accident By The Intersection Of Oregon Avenue and Road 28 1/2 –> Intersection May Be Dangerous
MADERA, CALIFORNIA (August 3, 2019) – An 82-year-old woman identified as Elvira Zuniga Valencia has tragically died in a car accident with a semi-truck that injured Maria Barajas Gonzalez.
Madera police are saying that the accident happened around noon on Tuesday by Oregon Avenue and Road 28 1/2 / Raymond Road. Maria Barajas Gonzalez was with her passenger Elvira Zuniga Valencia at a two way stop just prior to the accident.
Maria Barajas Gonzalez was pulling into the intersection when a large commercial truck struck the passenger side of the vehicle. Paramedics were called to the scene because Elvira Zuniga Valencia sustained critical injuries.
Unfortunately, first responders were not able to save Elvira Zuniga Valencia and she was pronounced dead at the scene. Madera police officials told reporters that poor visibility at the intersection may have contributed to the crash.
There are numerous large trees on one side of the road that make it difficult to see oncoming traffic. An investigation into the fatal car accident remains ongoing at this time.
The Dangers of Trees At Intersections
In order to drive safely drivers need to be able to detect and identify other drivers around them. In order for this to happen roads and intersections must have sufficient sight distance. According to Mike On Traffic, “Enough sight distance should be provided to assure drivers have sufficient sight distance to perform a safe passing maneuver without cutting off any vehicles.” Ideally, intersections should have sufficient sight distance so that drivers can see vehicles coming from the right and left.
Trees that are positioned near the corners of intersections can make it difficult for other drivers to see traffic. In some situations, it may literally be impossible to see oncoming traffic unless your vehicle is already partially sticking out in the road. Good road design avoids having trees near intersection corners. Depending on the fats of any case, a city may potentially be liable for an accident if it was caused by an overgrown tree blocking an intersection’s line of sight.
Liability In Accidents At Dangerous Intersections
Cities like Madera have a legal responsibility to make sure that their roads are in a reasonably safe condition. Traffic engineers should periodically inspect intersections and trees to make sure that they are safe. When a city receives constructive notice of an intersection that is in a dangerous condition they must take corrective measures to fix the issue. When there are multiple accidents at the same intersection this is usually indicative that there is a problem.
Trees that block driver’s line of sight are a hazard and should be removed. Cities can be held liable for accidents caused by trees through California Government Code 835. There have been numerous California court decisions affirming the liability of a city for failing to remove trees that block stop signs, street lights or otherwise obstruct a driver’s view.
The family of any victim that died in an accident at a dangerous intersection may have legal recourse through California Code of Civil Procedure 377.60. Damages in a civil claim can help cover lost wages, medical bills, funeral expenses and pain and suffering. Unfortunately, cities will often fight viciously to try and deny liability for an accident caused by a dangerous intersection. A truck accident attorney can investigate all the facts of your case free of cost and get to the bottom of what happened.
