SAN DIEGO, CALIFORNIA (October 16, 2019) – An ultra-marathon runner identified as Elijah Reid lost part of his leg in a hit-and-run car accident while riding a motorcycle on Highway 80.

California Highway Patrol are saying that Elijah Reid was riding his motorcycle around 6:30 a.m. when another driver made a left-turn into him. The driver got out of his car to pick up damage from his vehicle before fleeing the scene.

Elijah Reid had to be airlifted to the hospital in order to receive treatment for two broken legs and a nearly detached foot. Unfortunately, the victim developed an infection in his left foot and it had to be amputated.

The driver that fled the scene has been arrested according to one update. You can help support Elijah Reid through Go Fund Me

Liability In Hit-And-Run Accidents

It is a felony to flee the scene of an accident that results in bodily injury. According to California Vehicle Code 20001, “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident and shall fulfill the requirements of Sections 20003 and 20004.” There are a number of reasons why a driver may choose to flee an accident:

  • They may be intoxicated
  • They may fear going to jail
  • They may believe that they can get away with it

There is simply no reason why a driver should ever turn into the path of a motorcyclist. Drivers are supposed to yield the right of way to oncoming vehicles close enough so as to pose a hazard before turning. According to California Vehicle Code 21801, “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement.”

Victims of hit-and-run collisions are protected by a number of laws including Prop 213. Under Prop 213, even if the at fault driver does not have insurance victims may be able to collect economic damages such as lost wages and medical expenses. A motorcycle accident attorney can examine all of the facts of your case free of cost and let you know what your legal options are. There are, however, statute of limitations associated with filing civil claims. It is therefore important to act quickly.
