Liability In Boat Fires
Boat fires are actually a lot more common than many people think. The causes of boat fires are actually fairly predictable. According to insurance claim filings from BoatUS Marine, nearly 2/3 of all boat fires were the result of electrical or engine problems. For a fire to break out on a boat there needs to be a fuel source. In most cases that would be gasoline. There also needs to be an ignition source. Faulty engines or poorly implemented wiring are often too blame.
Depending on how a boat fire took place there may be numerous sources of liability for the accident. If the fire took place at a fueling station there could potentially be liability on the part of that business. All companies in California have a legal responsibility to maintain their premises in a reasonably safe manner.
According to California Civil Code 1714, “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.” A boat manufacturer could also be held liable for a boat fire.
Most people do not construct their own boat or any of its constituent parts. If a flash fire occurs on a boat that is typically strong evidence that the boat was defective in some way. If a boat was defective the company that manufactured or designed the boat could be held liable through product liability law. As mentioned previously, many boat fires take place due to faulty wiring. A boat accident attorney can investigate your case free of cost and let you know what your legal options are.
Any person that is injured in a boat accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Burn injuries in particular can leave victims needing painful skin grafts and high medical bills. There are very strict statute of limitations associated with filing a civil claim. It is therefore important to act quickly.
