Liability In Santa Fe Springs Truck Accidents
According to one report from the Federal Motor Carrier Safety Administration, “The total Large Truck Crash Causation Study (LTCCS) sample of 963 crashes involved 1,123 large trucks and 959 motor vehicles that were not large trucks. The 963 crashes resulted in 249 fatalities and 1,654 injuries. Of the 1,123 large trucks in the sample, 77 percent were tractors pulling a single semi-trailer, and 5 percent were trucks carrying hazardous materials. Of the 963 crashes in the sample, 73 percent involved a large truck colliding with at least one other vehicle.” There are many factors associated with fatal truck accidents including:
- Unfamiliarity with roadway
- Roadway problems
- Required to stop before crash (traffic control device, crosswalk)
- Over-the-counter drug use
- Inadequate surveillance
- Cargo Shift
Motorcyclists tend to be at a much greater risk for serious injury or death. This is due in part for two reasons. Motorcyclists are smaller than passenger vehicles. Motorcycles are inherently less crash worthy than passenger vehicles. A number of motorcycle accidents take place when truck drivers make dangerous left turns in front of motorcyclists.
According to California Vehicle Code 21801, “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”
When a truck driver is negligent and causes an accident the company that they work for may face civil liability. Generally speaking, companies are liable for the negligent conduct of their employees – insofar as those employees are working within the course and scope of their job duties. Moreover, in many situations a truck company could be liable for an accident if they negligently retained or hired an unsafe truck driver.
The family of any victim that died in a truck accident may have legal recourse through California Code of Civil Procedure 377.60. Damages in a civil claim can help cover lost wages, medical bills, emotional trauma and pain and suffering. It’s important that evidence is preserved after an accident. Most commercial trucks are equipped with event data recorders. These can be helpful in determining what a truck driver was doing right before an accident. A truck accident attorney can investigate your case free of cost and get to the bottom of what happened.
