DURHAM, CALIFORNIA (June 5, 2019) – Two people identified as Donald Shippen, Apryl Shippen died in a dump truck accident on Highway 99 that injured Kalen Shippen, Kristopher Blee, Ellen Blee and Olivia Blee.
California Highway Patrol are saying that a three-axle Volvo dump truck was traveling down Highway 99 at 55 mph. The driver was unable to slow down for the traffic that was stopped on the road.
The dump truck collided with a Chevrolet carrying Donald Shippen, Apryl Shippen and Kalen Shippen. Firefighters and paramedics rushed to the scene and had to cut the victims out of the car.
Unfortunately, Donald Shippen and Apryl Shippen later died due to their injuries. Their daughter Kalen Shippen was transported to the Enloe Medical Center with major injuries.
A Toyota minivan was also hit by the dump truck. Three people identified as Kristopher Blee, Ellen Blee and Olivia Blee were critically injured following the crash. All three also had to be taken to the Eloe hospital as well.
An accident reconstruction team was called to the scene in order to determine what happened. It remains unclear if the dump truck driver will be cited or face any charges for the fatal crash.
What To Do After A Dump Truck Accident
According to the FMCSA, nearly 5,000 people are killed every year in truck accidents. The vast majority of these collisions are completely preventable. Studies have shown that truck drivers are more likely to be involved in an accident if they are fatigued. There are a number of steps that victims should take following a truck accident:
- Take pictures of the vehicles involved and of the scene of the accident
- Get the name and insurance information of all parties involved
- Call the police and get an incident number
- Seek medical care for your injuries. Insurance companies may try to argue that you weren’t really injured if you don’t seek treatment.
- Don’t give any statement to the insurance adjusters of the dump truck company.
- Seek the legal advice of a truck accident attorney.
Dump truck companies will often work hard to deny liability for an accident. When they aren’t able to deny liability they may try to downplay the extent of a person’s injuries. An attorney can make sure that key pieces of evidence are being preserved and that your rights are being protected.
Liability In Dump Truck Accidents
Truck drivers are supposed to remain vigilant at all times and maintain a safe distance with the vehicle ahead of them. Because of their weight dump trucks take much longer to stop than sedans and other cars. According to California Vehicle Code 21703, “The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicle and the traffic upon, and the condition of, the roadway.”
If a dump truck driver rear-ends another vehicle that is fairly strong evidence that they were either speeding, distracted or following the lead vehicle too closely. On rare occasions, problems with the truck itself may contribute to an accident. Faulty brakes could prevent it from slowing down in time. Or if the truck was overloaded this could cause the brakes to give out.
The family of any victim that died in a dump truck accident may have legal recourse through California Code of Civil Procedure 377.60. Those that were injured in an accident may also be able to seek justice. Damages in a civil claim can help cover property damages, funeral expenses, medical bills, lost income and pain and suffering. A dump truck accident attorney can examine the specific facts of your case and let you know what your rights are.
