Liability In Car Accidents

According to the Centers For Disease Control,  “In 2016, 10,497 people died in alcohol-impaired driving crashes, accounting for 28% of all traffic-related deaths in the United States. Of the 1,233 traffic deaths among children ages 0 to 14 years in 2016, 214 (17%) involved an alcohol-impaired driver.” Even a moderate amount of alcohol can have very serious and adverse implications for a person’s ability to drive safely including:

  • Blurred vision
  • Reduced coordination
  • Impaired judgement
  • Lowered alertness
  • Difficulty steering

It is a felony to operate a motor vehicle under the influence of alcohol and cause an accident that results in injury. According to California Vehicle Code 23152, “(a) It is unlawful for a person who is under the influence of any alcoholic beverage to drive a vehicle. (b) It is unlawful for a person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle.” Victims of DUI accidents may be entitled to numerous sources of aid.

Public officials and all employees in California will typically be entitled to worker’s compensation if they are injured while they are on the job. An injured worker may also be able to seek damages by filing a bodily injury claim against the at fault driver. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A car accident attorney can examine all of the facts of your case and let you know what your legal options are.
