David Turner Killed In Shandon Tour Bus Accident On Highway 46 East In San Luis Obispo County

SHANDON, CALIFORNIA (September 16, 2019) – David Turner, the sound engineer for Josh Turner, has tragically died in a tour bus accident on Highway 46 East. 

California Highway Patrol are saying that David Turner “DT”  was one of the road crew for Country artist Josh Turner. At least seven other people were injured in this bus accident. 

The Prevost bus was being leased from All Access Coaches in Gallatin. For reasons that remain under investigation, the tour bus veered off of the road and over a cliff.

David Turner was ejected from the tour bus and tragically died due to his injuries. David Turner is not related to Josh Turner and worked for the country star for nearly 14 years.

Josh Turner canceled his remaining tours and will reschedule them for a later date. Investigators are working to see if there was a malfunction with the tour bus leading up to the crash. 

Causes of Bus Accidents

According to one report from the FMCSA, nearly 4,000 are killed in bus accidents and truck accidents across the United States every year.  ” Elements that influence the occurrence of a crash may take place hours, days, or months before the crash. They include driver training and experience, vehicle design and manufacture, highway condition and traffic signaling, and weather conditions. Other elements may take place immediately before a crash, such as a decision to turn in traffic, a tire blowout, or snow,” stated the report. Here are just a few of the other factors commonly associated with bus accidents:

  • Brake problems
  • Traffic flow interruption (congestion, previous crash)
  • Prescription drug use
  • Traveling too fast for conditions

It’s important that evidence is preserved after a crash. Buses are supposed to be properly maintained, but this does not always happen. For example, because of their large size and weight buses are more prone to experience brake problems. Liability In Tour Bus Accidents

Tour buses are considered “common carriers” under the law and are therefore held to a very high standard in terms of safety. According to Squaw Valley Ski Corporation v. Superior Court, “The elevated standard of care for common carriers is “based on a recognition that the privilege of serving the public as a common carrier necessarily entails great responsibility, requiring common carriers to exercise a high duty of care towards their customers.” There are a number of entities related to a tour bus that could be liable in the event of an accident. 

Tour companies are have a legal responsibility to enter in a contract with a bus company that has a clean driving record. If a tour bus company contracts with a bus company that has a history of safety violations they may be liable in the event of a crash. In addition to liability on the part of a tour bus company, the bus company that owns the vehicle involved in an accident may also face civil liability. 

Bus companies are liable for the negligent actions of their bus drivers. But in many cases bus drivers aren’t solely to blame for an accident. An accident may be due in part to a mechanical malfunction with the bus itself. Poor maintenance is far too often to blame with these types of accidents. If records show that a bus company was not adequately maintaining their fleet that could be another source of potential liability.
