Liability In Hit-And-Run Car Accidents
According to one report from the People Powered Movement, Los Angeles is the 10th most dangerous city in the county for bicyclists. Many drivers simply don’t see bicyclists due to their small profile. This is made worse by the large number of complex and winding streets throughout Los Angeles. Every driver has a legal responsibility to stop after an accident.
It is a felony to flee the scene of an accident that results in bodily injury. According to California Vehicle Code 20001, “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident and shall fulfill the requirements of Sections 20003 and 20004.” Drivers that flee the scene of an accident may face hefty fines, jail time or both.
Even if a bicyclist is out of a designated crosswalk drivers must still exercise caution to avoid hitting them. According to California Vehicle Code 21950, “The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.” Victims of bicycle accidents tend to suffer from very serious and costly injuries including:
- Broken bones
- Spinal cord injuries
- Head injuries
- Organ damage
If the at fault driver was working at the time of an accident the company or school district that they were working for may face vicarious liability. Generally speaking, school districts are liable for the negligent actions of their employees – insofar as those employees were working within the course and scope of their job duties. It’s important that drivers are properly questioned and that evidence is preserved after an accident.
Any person that is injured in an accident with a negligent driver may have legal recourse through a bodily injury claim. Damages in a bodily injury claim can help cover lost wages, medical bills and pain and suffering. Unfortunately, school districts will often fight hard to try and deny liability for any accident. A car accident attorney can examine all of the facts of your case and let you know what your legal rights are.
