Dan Arriola Stockton: Dan Arriola Injured In Stockton Car Accident By The Intersection of California Street and Weber Avenue

STOCKTON, CALIFORNIA (August 1, 2019) – A pedestrian identified as Dan Arriola was injured in a car accident by the intersection of California Street and Weber Avenue. 

Stockton police are saying that Dan Arriola  is a Tracy City councilman and a deputy district attorney. A male driver making a left turn hit the victim while he was lawfully in a crosswalk. 

Dan Arriola was thrown 40 feet from the pavement. Paramedics rushed to the scene and transported him the to San Joaquin General Hospital. 

The driver that hit the victim said that he did not notice him because of the sun. An investigation remains ongoing at this time. 

Liability In Pedestrian Accidents

According to California Vehicle Code 21801, “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement.” Depending on the facts of any case liability may extend beyond a driver.

According to California Government Code 835, “Except as provided by statute, a public entity is liable for injury caused by a dangerous condition of its property if the plaintiff establishes that the property was in a dangerous condition at the time of the injury, that the injury was proximately caused by the dangerous condition.” If a city was given constructive notice of a dangerous condition they should typically take measures to correct the problem.
