Dan Arriola was thrown 40 feet from the pavement. Paramedics rushed to the scene and transported him the to San Joaquin General Hospital.
The driver that hit the victim said that he did not notice him because of the sun. An investigation remains ongoing at this time.
Liability In Pedestrian Accidents
All drivers have a legal responsibility to operate their vehicles in a safe manner and to keep an eye out for pedestrians. If a driver hits a pedestrian while making a left turn they will typically be held at fault. According to California Vehicle Code 21801, “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement.” Depending on the facts of any case liability may extend beyond a driver.
A city could be liable for an accident if it was caused by a dangerous condition on public property. According to California Government Code 835, “Except as provided by statute, a public entity is liable for injury caused by a dangerous condition of its property if the plaintiff establishes that the property was in a dangerous condition at the time of the injury, that the injury was proximately caused by the dangerous condition.” If a city was given constructive notice of a dangerous condition they should typically take measures to correct the problem.
Any person that is injured in a car accident may have legal recourse through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. A pedestrian accident attorney can examine all of the facts of your case free of cost and let you know what your legal options are. There are, however, statute of limitations associated with pursuing a civil claim.
