Liability In Lifeguard Truck Accidents
Lifeguards that work at the beach are usually employed by the city. If they are negligent the city that employed them will typically be vicariously liable. This is generally the case based on the legal doctrine of respondeat superior. According to the Cornell Law Dictionary, respondeat superior is “a legal doctrine, most commonly used in tort, that holds an employer or principal legally responsible for the wrongful acts of an employee or agent, if such acts occur within the scope of the employment or agency.”
Beaches can be particularly difficult places to navigate for trucks. They are filled with pedestrians and are poorly illuminated once the sun goes down. Drivers are supposed to exercise a great deal of caution in order to prevent pedestrian accidents. According to California Vehicle Code 21950 (c), “The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.”
There is simply no excuse for any driver to hit a pedestrian on the beach. Statistically speaking, accidents tend to happen because drivers are speeding, distracted, fatigued or intoxicated. Pedestrians that are hit by trucks tend to suffer from very serious injuries. According to the NCBI, “Traffic-related pedestrian injuries are a growing public health threat worldwide. In 2004, there were 4,641 pedestrian deaths and over 70,000 injuries in the United States. Injury patterns vary depending on the age, gender and socioeconomic status of the individual. Children, older adults, and those of lower socioeconomic status are most affected.”
Any person that is injured in a pedestrian accident may have legal recourse through a bodily injury claim. Damages in a bodily injury claim can include compensation for medical bills, lost wages and pain and suffering. Victims tend not to realize the full extent of their injuries until several weeks or months after an accident. Children often have it the worst because injuries can affect their development. A pedestrian accident attorney can examine all of the facts of your case free of charge and let you know what your legal options are. Failing to take action within the statute of limitations may result in a permanent forfeiture of your rights.
