The Dangers Of Parking Lots
Parking lots can be a lot more dangerous than many people think. According to the National Safety Council, there are around 50,000 crashes that occur every year in parking lots across the United States. The holiday season, in particular, can be especially dangerous. In a survey of driver behavior in parking lots respondents admitted to the following behavior:
Using their cellphone (66%)
Programming a GPS Unit (63%)
Utilizing social media (52%)
Checking emails (50%)
Taking photos or watching videos (49%)
It’s important for pedestrians to stay alert and for drivers to proceed slowly in parking lots. Watch for pedestrians that may be walking behind or around your vehicle. If you are injured while walking in a parking lot it’s important to seek the advice of an experienced pedestrian accident attorney.
Liability In Parking Lot Accidents
Depending on a number of factors, there could potentially be numerous sources of liability involving a pedestrian accident in a parking lot. For example, a driver could be at fault for being inattentive and hitting a pedestrian. This is almost always the case with hit-and-run accidents in parking lots. A driver may not have been paying attention, hit a pedestrian (knowingly or unknowingly) and taken off. Most parking lots are covered by security cameras for safety reasons and this footage can be instrumental in helping determine liability after an accident.
In addition to any potential negligence on the part of a driver there may also be negligence on the part of a property owner for failing to maintain their parking lot. Property owners have to make sure that parking lots are reasonably safe and have the necessary equipment to protect pedestrians. This may include installing marked crosswalks, bollard posts and stop signs. A lawyer familiar with premises liability law can investigate your case and let you know what your rights are. Victims of parking lot accidents may be able to file a claim for damages.
