Liability In Bicycle Accidents
According to the NHTSA, “There were 783 bicyclists killed in traffic crashes in the United States in 2017. As you might expect, when a crash occurs between a vehicle and a bike, it’s the cyclist who is most likely to be injured.” There are a number of reasons that bicycle accidents occur:
- Driver distraction: Drivers are often preoccupied with merging traffic and may not notice a pedestrian in the crosswalk.
- Driver intoxication: A disproportionate number of drivers that hit pedestrians are under the influence.
- Driver fatigue: Driver’s get tired like everyone else and may overlook pedestrians in the crosswalk.
A good driver is supposed to remain vigilant and yield the right of way to bicyclists that are in lawfully marked crosswalks. According to California Vehicle Code 21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.”
Any person that is injured in a bicycle accident due to the negligence of another driver may be able to seek justice through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. A bicycle accident attorney can examine all of the facts of your case and let you know what your legal options are. It doesn’t cost anything to hire an attorney and they only get paid if they are able to successfully resolve your case.
