Liability In Taxi Accidents
Taxi drivers are considered “common carriers” under the law. As such, they are held to a very high standard in terms of safety. According to Squaw Valley Ski Corporation v. Superior Court (1992), “The elevated standard of care for common carriers is “based on a recognition that the privilege of serving the public as a common carrier necessarily entails great responsibility, requiring common carriers to exercise a high duty of care towards their customers.”
Taxi drivers are also held to a higher standard in terms of what (BAC) is considered legally intoxicated. Commercial drivers are considered intoxicated if they have a (BAC) of 0.04 or higher. This is compared to 0.08 for non-commercial drivers. Any person that is injured in an accident with an intoxicated driver may have legal recourse through a bodily injury claim. Damages can include compensation for lost wages, medical bills and pain and suffering. A car accident attorney can examine all of the facts of your case and let you know what your options are.
