Liability In Pedestrian Accidents
According to the Centers For Disease Control and Prevention older pedestrians are at a greater risk of being involved in car accidents. Per a CDC report, “Pedestrians ages 65 and older accounted for 20% of all pedestrian deaths in 2016 and an estimated 15% of all pedestrians injured in 2015.” There are a number of reasons that pedestrian accidents take place including:
- Distracted drivers
- Intoxicated drivers
- Road design defects
- Fatigued driving
Good drivers are supposed to keep an eye out for pedestrians in lawfully marked crosswalks. According to California Vehicle Code 21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.” Victims of pedestrian accidents are protected by a number of laws.
Any person that is injured in a car accident due to the negligence of another may have legal recourse through a bodily injury claim. Damages in a bodily injury claim can help cover lost wages, medical bills and pain and suffering. A pedestrian accident attorney can examine all of the facts of your case and let you know what your legal rights are.
