OXNARD, CALIFORNIA (June 27, 2019) – A 42-year-old pedestrian identified as Bonifacio Amayo Tetzoyotl has tragically died in a car accident by the intersection of Savier Road and Hueneme Road.
California Highway Patrol are saying that Bonifacio Amayo Tetzoyotl was in a crosswalk when he was hit by a gray Ford Focus.
A witness told police that the accident began when a white pickup turned left into the path of a Ford. Both vehicles swerved, but Bonifacio Amayo Tetzoyotl was hit by the Ford focus.
An ambulance took the victim to the Ventura County Medical Center where he later died. An investigation into the accident remains ongoing.
Liability In Pedestrian Accidents
Drivers are supposed to yield the right of way to vehicles that are close enough to pose a hazard before making a left turn. If a driver hits another vehicle or pedestrian while making a left turn they will likely be found at fault. According to California Vehicle Code 21801, “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement.”
The family of any victim that died in a pedestrian accident may be able to seek justice through California Code of Civil Procedure 377.60. Damages can help cover medical bills, lost wages, funeral expenses and emotional trauma. A pedestrian accident attorney can examine all of the facts of your case and let you know what your options are. There are, however, statute of limitations associated with being able to pursue a claim, so it’s important to act quickly.
