Car Accidents Caused By Debris In The Roadway
There have been around 200,000 accidents over the last four years caused by debris in the roadway. This has led to 39,000 injuries and over 500 deaths. Objects like sofas or shredded tires in the road continue to be a major problem. At least one third of the accidents took place as cars were attempting to avoid hitting the debris. It is extremely important that drivers work to secure their load. Ideally, this should be done by a professional who has access to the necessary materials. Depending on the facts of the case, victims of accidents caused by road debris may have legal recourse.
Liability In Accidents Involving Debris In The Roadway
Accidents caused by debris in the roadway often result in serious injuries and even death. Victims may have multiple routes to pursue a claim for damages. These may include:
Driver Negligence: Drivers have a responsibility to properly secure their load and proceed with caution as they are transporting items. A number of accidents occur when speeding drivers spill their loads onto the roadway. Items should be properly secured with multiple strands of rope or tape. Loads should not be topheavy and sticking high into the air. A little bit of common sense can go a long way.
Product Liability Claims: On certain occasions, latches can come undone and cause a vehicle to lose its cargo. If this happened, the manufacturer of the car may face liability for any resulting injuries or deaths.
Vicarious Liability Claims: Companies that load items onto a vehicle may face liability for an accident if their employees did an inadequate job of securing the load. Usually when you buy a refrigerator or large item the business where you purchased it will load it up for you. Moreover, if a truck loses it’s cargo the company that hired them could be responsible. In many circumstances, commercial trucks are the vehicles that lose items in the roadway.
Municipal Negligence: Cities and state agencies have a responsibility to keep the roadways reasonably safe. This includes taking steps to remove active hazards like debris. If they fail to do this in a timely fashion they could be held liable for an accident. Moreover, if a defect in the roadway caused debris to come loose that could impose liability on a municipal entity. For example, a number of items come loose when a car a truck hits a large pothole.
Victims of an accident caused by road debris can often feel overwhelmed. Among other things, the person responsible is usually not immediately known. An experienced motorcycle accident attorney can take steps to help preserve your rights.
