Liability In Palm Desert Bicycle Accidents

According to the People Powered Movement, “Statistics show that while the overall number of bicycle accidents in the country is declining, the number of fatal bike accidents is on the rise. In 2015, there were 45,000 reported bicycle accidents in the United States, down from 50,000 reported accidents in the prior year.” There are a number of reasons why bicycle accidents take place:

  • Drivers may be fatigued
  • Drivers may be intoxicated
  • Drivers may be distracted
  • Drivers may be speeding

Bicyclists have all of the rights of drivers. According to California Vehicle Code 21200, “A person riding a bicycle or operating a pedicab upon a highway has all the rights and is subject to all the provisions applicable to the driver of a vehicle by this division, including, but not limited to, provisions concerning driving under the influence of alcoholic beverages or drugs.”

Drivers that hit bicyclists while making left turns are likely to be found at fault. According to California Vehicle Code 21801, “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement.” Victims of bicycle accidents are protected by a number of laws.

Any person that is injured in a bicycle accident may be able to recover damages through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. A bicycle accident attorney can examine all of the facts of your case and let you know what your legal options are.
