Causes of Semi-Truck Accidents
According to one report from the FMCSA, there are hundreds of factors associated with truck accidents. But there are ten in particular that account for the vast majority of injury accidents.
- Brake problems
- Traffic flow interruption (congestion, previous crash)
- Prescription drug use
- Traveling too fast for conditions
- Unfamiliarity with roadway
- Roadway problems
- Required to stop before crash (traffic control device, crosswalk)
- Over-the-counter drug use
- Inadequate surveillance
Driving a semi-truck is much more difficult than driving a non-commercial vehicle. This is why truck drivers need a special license and adequate training. Truck drivers are put under enormous pressure to make all of their deliveries on time. More than anything else, truck driver fatigue is positively associated with accidents. Depending on the facts of any case, there may be multiple sources of liability for a truck accident.
Liability In Truck Accidents
Truck drivers have a responsibility to keep an eye out for other vehicles. This includes yielding the right of way to other vehicles before making turns. According to California Vehicle code 21801, “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement.” Unfortunately, motorcyclists often get overlooked because of their small profile.
Trucks also tend to have large blind spots that can make it difficult for drivers to see oncoming vehicles. This is why everyone is taught to avoid driving next to semi-trucks. Determining if a truck driver made a dangerous maneuver can be a difficult proposition. Surveillance footage can help reveal what led up to an accident. But it’s not always available. Accident reconstruction can help piece together the moments immediately before a crash and reveal who was at fault.
The family of any victim that died due to the negligence of a truck driver is able to seek justice through California Code of Civil Procedure 377.60. A victim’s next of kin could include their children, siblings, parents and spouse. Unfortunately, truck companies will often work hard to deny liability after an accident. It’s also important evidence and eye witness testimony is preserved. A truck accident attorney can examine all of the facts of your case free of cost and make sure that your rights are being protected.
