GILROY, CALIFORNIA (September 25, 2019) – One person has died and at least four people from Boulder Creek identified as Alysha Flowers, Sophi Davi, Deborah Davi and Joseph Davi were injured in a semi-truck accident on Highway 152.

California Highway Patrol are saying that the truck accident took place around 8:30 p.m. not far from the Casa de Fruita stores and restaurant. A 53-year-old truck driver from Union City rear-ended a pickup truck being driven by Gonzalo Hernandez-Mendez.

The pickup truck being driven by the victim was then pushed into another vehicle carrying Alysha Flowers, Sophi Davi, Deborah Davi and Joseph Davi from Boulder Creek.

Paramedics were called to the scene in order to help all of the victims. Gonzalo Hernández Méndez tragically died as a result of the accident. A Go Fund Me page has been set up for his funeral expenses. 

Alysha Flowers, Sophi Davi, Deborah Davi and Joseph Davi were taken to the hospital in order to receive treatment for injuries ranging from moderate to serious. 

The truck driver involved in the accident remained at the scene and cooperated with police. 

Regulations and Rules For Truck Drivers

A list of all of the rules and regulations for commercial truck drivers can be found in Title 49 of Code of Federal Regulations. For example, truck drivers must undergo special training and a physical exam every two years in order to make sure that they are fit to drive. There are also numerous rules with respect to alcohol:

  • Truck drivers must not have a BAC of 0.02 or higher when reporting for duty.
  • Truck drivers cannot carry alcohol unless it is cargo
  • Truck drivers cannot have any drugs or prescriptions in their system that could affect driving 8 hours prior to starting their shift. 

Cargo must also be properly secured. Failing to properly secure cargo can cause an accident because shifting cargo can make the truck unstable. Cargo should typically be tied down in order to prevent it from moving. Depending on the facts of any case there may be numerous sources of liability for a truck accident.

Liability In Semi-Truck Accidents

Semi-truck drivers must use caution when operating their vehicles. Following a car too closely is not only dangerous it is illegal under California Vehicle Code 21703. According to the California DMV Handbook, “To avoid last minute moves, scan the road 10–15 seconds ahead of your vehicle so you can see hazards early. Constantly staring at the vehicle or road right in front of your vehicle is dangerous. As you scan ahead, be alert for vehicles around you. Use your mirrors. Know what is behind you, so you can prepare for what is ahead.”

Many accidents happen between the hours of 6:00 p.m. to 9:00 p.m. because there is less visibility. There is no reason why a truck driver should ever rear-end another vehicle.
