Alexander Clark Bicycle Accident: 24-Year-Old Man From The United Kingdom Identified As Alexander Clark Seriously Injured In Car Accident After Being Hit By Caltrans Truck On Highway 101 Near Wilson Lane In Smith River
SMITH RIVER, CALIFORNIA (March 2, 2019) – A bicyclist from the United Kingdom identified as Alexander Clark was seriously injured after being hit by a Caltrans truck on the U.S. Highway 101.
The victim was riding his bicycle southbound on Highway 101 in Smith river during a dark and rainy night. A Caltrans truck driver was attempting to pass the victim but ended up hitting him with the truck’s side mirror.
The force of the impact caused Alexander Clark to be thrown off his bicycle. Firefighters and paramedics rushed to the scene of the collision and transported the victim to the Sutter Coast Hospital in critical condition.
He suffered numerous injuries including broken ribs, a broken pelvis, a ruptured kidney, a ruptured spleen and a broken scapula. California Highway Patrol interviewed the Caltrans driver and are seeking witnesses testimony about the accident.
Civil Liability For California Truck Accidents
Truck drivers must exercise great caution in order to prevent accidents and injury. Truck drivers must also undergo periodic medical exams to ensure they are healthy enough to drive safely. Failure to adhere to safety standards often results in crashes. According to the Federal Motor Carrier Safety Administration (FMCSA), “Single-vehicle crashes (including crashes that involved a bicyclist, pedestrian, nonmotorized vehicle, etc.) made up 22 percent of all fatal crashes, 14 percent of all injury crashes, and 24 percent of all property damage only crashes involving large trucks in 2016.”
Caltrans employees are agents of the state of California. When they are negligent while working within their duties, the municipality that hired them may bear civil liability. According to the Judicial Council of California Civil Jury Instructions, “an employer is vicariously liable for the torts of its employees committed within the scope of the employment.” For any accident, there may be additional sources of negligence beyond a careless driver. For example, a city may be liable for a bicycle accident caused by a dangerous condition in the roadway.
According to California Government Code 835, “Except as provided by statute, a public entity is liable for injury caused by a dangerous condition of its property.” There are numerous ways in which a road could be defective and plausibly contribute to a car accident. For example, a shoulder could be too narrow. California Department of Transportation regulations require that: “[T]he shoulder shall be a minimum of 4 feet width to the right of the grooved rumble strip when a vertical element, such as curb or guardrail is present or a minimum of 3 feet width when a vertical element is not present.”
Any person that is injured in a Caltrans truck accident may be able to file a personal injury claim for damages. The average cost to treat an injured person following a truck accident is estimated to be $200,000. This is why most trucks in California are required to carry between $500,000 – $1,000,000 worth of liability coverage. A truck accident attorney can fight on your behalf and make sure that your medical and financial needs are taken care of if you’ve been injured. There are zero costs associated with hiring an attorney and they only get paid if they end up winning or settling your case.
