Alejandra and Leopoldo love their horses and considered them a member of the family. They are devastated over the loss of the horses and Leopoldo worries about not being able to support the family during this crisis.”
An investigation into the accident remains ongoing at this time.
Liability In Hit-And-Run Accidents
It is a felony to flee the scene of an accident that causes bodily injury. According to California Vehicle Code 20001, “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident and shall fulfill the requirements of Sections 20003 and 20004.” There are a number of reasons that hit-and-run accidents occur including:
- Driver intoxication
- Driver fatigue
- Driver distraction
- Drivers who have a suspended licence
Pedestrians that are injured in hit-and-run accidents are protected by a number of laws. For example, they may be able to file a bodily injury claim in order to recover compensation for lost wages, medical bills and pain and suffering. Even if the at fault driver does not have car insurance victims may still have legal recourse through Prop 213. A car accident attorney can examine all of the facts of your case and let you know what your legal options are.
