Adnan Nijmeddin Fresno: Adnan Nijmeddin Killed In Fresno Motorcycle Accident With Semi-Truck On Shaw Avenue and Golden State Boulevard
FRESNO, CALIFORNIA (August 6, 2019) – A 25-year-old man identified as Adnan Nijmeddin has tragically died in a semi-truck accident while riding a motorcycle by Shaw Avenue and Golden State Boulevard.
Fresno police are saying that Adnan Nijmeddin was riding his motorcycle with a 32-year-old man around 3:00 p.m. For reasons that remain under investigation, a semi-truck driver pulled in front of the two victims as it was turning north.
The force of the impact seriously injured both Adnan Nijmeddin and the second man. It also sparked a gas leak which caused the 32-year-old motorcyclist to catch fire.
Thankfully, a bystander with a fire extinguisher was able to put out the fire before paramedics arrived. Despite life-saving efforts Adnan Nijmeddin died due to his injuries.
The 32-year-old victim was rushed to the hospital in critical condition. An investigation into the Fresno semi-truck accident remains ongoing at this time.
Causes Of Semi-Truck Accidents
According to one study from the NHTSA, “there were approximately 120,000 fatal and injury crashes nationwide during the 33-month study period that involved at least one large truck; 141,000 large trucks were involved in those crashes.” Here are just a few of the most common reasons that truck accidents tend to take place:
- Brake problems
- Made illegal maneuver
- Prescription drug use
- Illegal drugs
- Unfamiliarity with roadway
- Roadway problems
- Cargo shift
- Over-the-counter drug use
- Inadequate surveillance
Motorcyclists and pedestrians are at a much greater risk from truck accidents. They are smaller and therefore more likely to be overlooked. In the event of an accident they have less protection. Depending on the facts of any case, there may be numerous sources of liability for a truck accident.
Liability For Truck Accidents
All truck drivers have a legal responsibility to operate their vehicles according to the prevailing conditions. Truck drivers must yield the right of way to vehicles that are close enough so as to pose a hazard. According to California Vehicle Code 21801, “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement.”
If a truck driver is negligent they or the company that they work for may face liability for an accident. Companies are generally responsible for the negligent conduct of their employees – insofar as the employee was working within the course and scope of their job duties. Even if another driver was partially at fault for an accident they will not bar them or their family from potentially pursuing a civil claim.
The family of any victim that died in an accident with a semi-truck may be able to seek justice through California Code of Civil Procedure 377.60. Damages in a civil claim can help cover lost wages, medical bills, funeral expenses and pain and suffering. Unfortunately, many truck companies will often fight hard to deny liability following an accident. A truck accident attorney can examine the facts of your case free of cost and get to the bottom of what happened.
