ACAMPO, CALIFORNIA (April 24, 2019) – Two pedestrians were seriously injured in a truck accident after they were hit by a big rig while they were standing behind another big rig by the intersection of Dustin Road and Collier Road.
California Highway Patrol are saying that the truck accident took place around 5:52 a.m. by Oak View Elementary School. Firefighters and paramedics rushed to the scene and treated two people for major injuries.
The driver of the truck that hit the victims remained at the scene and cooperated with authorities. An investigation into the cause of the accident remains ongoing.
Liability In Accidents With Commercial Trucks
According to estimates from the FMCSA, over 4,000 people are killed every year in truck accidents. Like all other drivers, truck drivers are expected to follow the rules of the road and keep an eye out for pedestrians. According to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.”
A number of accidents take place in the early morning hours or late afternoon when there is decreased visibility. Ideally, drivers should slow down during this time, but that does not always happen. Fatigue often sets in and drivers may not be as alert as they otherwise would have been. Unfamiliarity with the roadway is another major factor in truck accidents. A fully-loaded semi-truck can weigh as much as 20,000 lbs. Victims of truck accidents often receive traumatic injuries including:
- Broken bones
- Internal trauma
- Head injuries
Those that are injured due to the negligence of truck drivers may have the ability to file a personal injury claim for damages. Damages in a bodily injury claim can include money for lost wages, medical bills and pain and suffering. A truck accident attorney can examine all of the facts of your case and let you know what your options are. It doesn’t cost anything to hire an attorney and they only get paid if they are able to successfully resolve your case.
