Sebastopol Truck Accident: 66-Year-Old Woman Injured In Sebastopol Box Truck Accident By Bodega Avenue and Main Street
SEBASTOPOL, CALIFORNIA (September 19, 2019) – A 66-year-old woman was injured in a Sebastopol truck accident near the intersection of Bodega Avenue and Main Street.
Sebastopol police are saying that the box truck driver was headed West on Bodega Avenue and made a left turn into the intersection before striking the victim. Neither drugs nor alcohol are believed to be factors in the crash.
Paramedics rushed to the scene of the accident in order to help the victim. She was described as being “conscious, alert and talking.” She was taken to the Santa Rosa Memorial Hospital in order to receive treatment.
The box truck driver remained at the scene and cooperated with police.
Liability In Box Truck Accidents
Truck drivers have a legal responsibility to operate their vehicles in a reasonably safe manner and to yield the right of way to pedestrians that are in lawfully marked crosswalks. There are a number of factors that may contribute to pedestrian accidents with commercial trucks. Fatigue, in particular, is the number one cause of serious injury truck accidents. Truck drivers are allowed to work up to 14 hours in a day. They are supposed to take breaks periodically and get enough sleep but this doesn’t always happen.
If a truck driver was making a left-turn leading up to an accident they will typically be held at fault. Drivers are supposed to yield the right of way to pedestrians and other vehicles before turning left. According to California Vehicle Code 21801:
“The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”
It’s important that evidence is preserved and that eye witness testimony is collected after a truck accident. Most intersections are equipped with surveillance footage. This can all be instrumental to holding a trucking company accountable for an accident. Unfortunately, many truck companies will often fight hard to deny liability after an accident. But this doesn’t have to be the case.
Truck accident victims are protected by a number of laws. They are able to hold the truck company that injured them accountable through a bodily injury claim. Damages in a civil claim can help with past medical bills, future medical bills, lost wages and pain and suffering. The FMCSA typically requires truck drivers who need federal filing to carry between $750,000 to $1,000,000 in liability insurance. A truck accident attorney can examine all of the specific facts of your case and let you know what your legal options are.
