60-Year-Old Man Injured In San Diego Car Accident By Liberty Station Near Rosecrans Street and Laning Road

SAN DIEGO, CALIFORNIA (October 3, 2019) – A 60-year-old pedestrian was seriously injured in a car accident not far from Liberty Station by the intersection of Rosecrans Street and Laning Road.

San Diego police are saying that the accident took place around 5:30 p.m. A man driving a Ford Fusion hit the victim as he was attempting to cross the street.

The driver was apparently attempting to turn right. Paramedics were called to the scene in order to help the victim. He was taken to the hospital in order to receive treatment.

Authorities are saying  that the pedestrian had a cross signal and that the driver also had a green turn light. It remains unclear if one or both of the lights may have been malfunctioning.

Neither drugs nor alcohol are believed to be factors in the crash.

Liability For San Diego Pedestrian Accidents

Drivers have a legal responsibility to operate their vehicles in a reasonably safe manner and to yield the right of way to pedestrians. According to California Vehicle Code 21950, “The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.” Pedestrians involved in car accidents tend to suffer a wide variety of injuries including:

  • Head injuries
  • Back injuries
  • Broken bones
  • Internal trauma

In many circumstances, though, accidents may not be singularly the fault of a driver. A city may face civil liability for a car accident if it was caused by a dangerous condition on public property. For example, a city could be liable for an accident under California Government Code 835 if a pedestrian was injured due to a malfunctioning street light. These types of claims can be extremely complex and are best examined by an experienced pedestrian accident attorney.

Any person that is injured in a car accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help with lost wages, medical bills and pain and suffering. It’s important to get consistent treatment after an accident and that evidence is preserved. A pedestrian accident attorney can examine all of the facts of your case and let you know what your legal options are.
