Liability In Motorcycle Accidents

According to the Insurance Information Institute, “Motorcycles are by their nature far less crashworthy than closed vehicles. They are also less visible to other drivers and pedestrians and less stable than four-wheel vehicles. Operating a motorcycle requires a different combination of physical and mental skills than those used in driving four-wheel vehicles.” No matter how safe a motorcycle rider is, there is always the very real possibility that they will be hit by other drivers who are not paying attention. For example, many motorcyclists are hit by truck drivers who make dangerous left turns. Every driver is supposed to scan the road ahead of them and wait until it is safe to make a left turn.

According to the California Vehicle Code 21801: “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.” Victims of motorcycle accidents typically receive very serious and costly injuries. This may include:

  • Traumatic brain injuries (TBI)
  • Spinal Cord Injuries
  • Lower-extremity injuries
  • Internal Trauma
  • Amputations
  • Bone Fractures
  • Death

Truck drivers that make dangerous left turns will typically be found at fault for an accident. If they were working during the time of a collision the company that they were working for may be found at fault as well. This is based on the legal doctrine known as vicarious liability. According to the Cornell Law Dictionary, vicarious liability is “Liability that a supervisory party (such as an employer) bears for the actionable conduct of a subordinate or associate (such as an employee) based on the relationship between the two parties.”

The family members of a victim that died in a truck accident may have legal recourse through California Code of Civil Procedure 377.60. According to the statute, a victim’s next of kin can recover damages through a wrongful death action for lost wages, medical bills and pain and suffering. There are statute of limitations associated with filing a claim, so it’s important to act quickly to secure your rights. A wrongful death attorney can investigate all of the unique facts of your case and let you know what your options are.
