11-Year-Old Boy Injured In Santa Rosa Bicycle Accident On River Road Near Highway 101
SANTA ROSA, CALIFORNIA (September 26, 2019) – An 11-year-old boy was seriously injured in a car accident while riding his bicycle along River Road not far from Highway 101.
California Highway Patrol are saying that the accident took place around 6:00 p.m. The driver of a Toyota Camry made a right turn onto the Highway 101 southern on-ramp when he hit the victim.
Paramedics rushed to the scene in order to help the bicyclist and transport him to the UCSF Benioff Children’s Hospital in Oakland. The driver of the Toyota Camry remained at the scene and cooperated with police.
Liability In Bicycle Accidents
All drivers have a legal responsibility to keep an eye out for pedestrians. Drivers are supposed to yield the right of way to pedestrians in lawfully marked crosswalks. According to California Vehicle Code 21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.”
Freeway on-ramps can be particularly dangerous. Drivers may not pay attention to pedestrians in the crosswalk near the on-ramp. A disproportionate number of accidents happen between 6:000 p.m. and 9:00 p.m. Drivers get fatigued as they are heading home or they may be distracted. Drivers are supposed to yield the right of way to pedestrians and other cars before turning.
Any person that is injured in a bicycle accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help with lost wages, medical bills and pain and suffering. A pedestrian accident attorney can examine all of the facts of your case and let you know what your legal options are.
