Liability In Box Truck Accidents
Commercial trucks are an extremely important part of our commerce system. They are one of the most economical ways to transport goods. There is a tremendous amount of pressure put on truck companies as well as truck drivers to operate as quickly and efficiently as possible. Unfortunately, this can have fatal consequences when the proper safety protocols are not being followed.
According to a 2007 study by the Federal Motor Carrier Safety Administration and the National Highway Traffic Safety Administration, fatigue was determined to be a critical factor in 13% of accidents involving large commercial trucks. Fully loaded trucks can weigh 80,000 lbs and even the slightest negligence can result in an accident. This is why it’s so important that any accident involving a commercial truck is thoroughly investigated. Most large trucks are equipped with “black box” type devices known as event data recorders.
A truck accident attorney can use the data from these devices along with traffic cameras to help determine liability. The family of a victim that dies in a truck accident will have the ability to file a claim for damages. If a truck driver was working when a collision took place, their company could potentially face vicarious liability for the accident. There are strict time requirements associated with being able to file a claim, so it’s important to act quickly.
