Liability For Ambulance Accidents
Ambulance drivers and other emergency vehicles must exercise a great deal of caution in order to avoid accidents. Emergency vehicles typically tend to have a great deal of immunity from civil claims in the event of an accident. But this is only the case if they were responding to an actual emergency and using their lights and sirens.
According to California Vehicle Code 21055, “The driver of an authorized emergency vehicle is exempt from Chapter 2 …. If the vehicle is being driven in response to an emergency call or while engaged in rescue operations or is being used in the immediate pursuit of an actual or suspected violator of the law or is responding to, but not returning from, a fire alarm.” If an ambulance is not using their lights and sirens they are held to the same standard as other drivers.
Any person that is injured in an accident with an ambulance may have legal recourse through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. Many victims may not even realize the full extent of their injuries until several weeks or months after an accident. a car accident attorney can examine all of the facts of your case and let you know what your options are.
