Janet Genao Temecula: 44-Year-Old Janet Genao From Murrieta Killed In Car Accident With Allegedly Drunk Driver On The Interstate 15 Freeway That Also Injured Mike Rivera-Aquilar

TEMECULA, CALIFORNIA (June 6, 2019) – A 44-year-old woman identified as Janet Genao has tragically died in a car accident with an allegedly drunk driver on the Interstate 15 freeway by Rancho California Road.

A 25-year-old driver from Washington has been charged with second-degree murder and felony DUI following the accident. The suspect was driving a 2011 Chevrolet Silverado in excess of 100 mph before hitting the back of Janet Genao’s vehicle.

The force of the impact caused a chain reaction involving a Chevy S-10 that then hit a parking garage near Temecula City Hall. Mike Rivera-Aquilar was in the Chevy that got hit.

He was taken to the hospital in order to receive treatment for broken ribs, a broken leg and facial fractures. The suspect in the accident was not given bail after investigators argued that he was a flight risk.

Drunk Driving Statistics

According to Mothers Against Drunk Driving (MADD), “About 4,000 drivers are killed each year with drugs in their systems. This doesn’t count those who had drugs in their system without test results, or those killed by drivers with drugs in their system.” Millions of people admit to driving under the influence every year. Most people are never caught unless they are involved in an accident. In fact, drunk drivers will operate their vehicle under the influence an astounding 80 times on average before their first arrest.

There are a number of ways to prevent drunk driving. The easiest solution is to simply not drink. If you’re going with a group of friends make sure that there is a designated driver. There are also an abundance of safe solutions if you do plan on going out someplace to drink. You can summon a ride with Uber or Lyft and not have to worry about how you’ll get home safe.

Liability In DUI Accidents

It is illegal to operate a motor vehicle under the influence of alcohol. According to California Vehicle Code 23152, “(a) It is unlawful for a person who is under the influence of any alcoholic beverage to drive a vehicle. (b) It is unlawful for a person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle.” Every person responds to alcohol differently. There are a number of factors that will influence your (BAC) including:

  • Age
  • Gender
  • Blood Type
  • Fat/Muscle Content
  • Metabolism
  • Hydration

A person that wants to always be on the safe side should probably buy a (BAC) breathalyzer. Those that choose to drive under the influence of alcohol will likely face criminal as well as civil liability. Any person that is injured in an accident with a drunk driver or their family may have legal recourse through a civil claim. Damages can help cover lost wages, medical bills, funeral expenses and pain and suffering. A car accident lawyer can examine all of the facts of your case and let you know what your legal options are.
