Liability In DUI Accidents

It is a felony to drive under the influence and cause an accident that results in bodily injury. According to California Vehicle Code 23152, “(a) It is unlawful for a person who is under the influence of any alcoholic beverage to drive a vehicle. (b) It is unlawful for a person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle.” Still, millions of people choose to drink and drive every year.

It has been estimated that nearly 40% of fatal car accidents involve an intoxicated driver. In many circumstances, drivers will operate their vehicle intoxicated dozens of times before they are finally caught.  People often misjudge their ability to driver safely and gain more confidence the more that they drink and drive. However, even before a person is legally impaired with a BAC of 0.08 alcohol will begin to erode their ability to drive safely.

Any person that is injured in car accident may have the ability to file a bodily injury claim for damages. Damages can help cover medical bills, lost wages and pain and suffering. A car accident attorney can examine all of the facts of your case and let you know what your legal options are. There are, however, statute of limitations for pursuing a claim, so it’s important to be proactive.
