Liability In Truck Accidents
An estimated 5,000 people are killed in truck accidents every years. Tens of thousands more are seriously injured. Truck drivers are held to a much higher standard than other drivers. Trucking companies are considered “common carriers” under the law and are held to a very high standard. According to the Judicial Council of California Civil Jury Instructions:
“While a common carrier does not guarantee the safety of its passengers[or property that it transports], it must use reasonable skill to provide everything necessary for safe transportation, in view of the transportation used and the practical operation of the business.”
According to a report by the FMCSA fatigue is one of the leading factors behind truck accidents. Here are just a few tips that the FMCSA recommends for truck drivers in order to help prevent fatigue.
- Get enough sleep before driving
- Maintain a balanced diet
- Take naps periodically to stay alert
- Avoid medications that may cause drowsiness
- Learn to recognize the signals of drowsiness
Any person that is injured in a truck accident may have the ability to recover damages through a personal injury claim. Most trucks are required to carry between $500,000 – $1,000,000 worth of liability coverage in the event of an accident. Most victims will not even be aware of the full extent of their injuries until several weeks or months following an accident. A truck accident attorney can examine all of the unique facts of your case and let you know what your options are.
