Liability In Truck Accidents
Trucking companies are considered “common carriers” under the law. They are expected to drive in a very cautious manner. According to the Judicial Council of California Civil Jury Instructions, “Common carriers must carry passengers [or property] safely. Common carriers must use the highest care and the vigilance of a very cautious person. They must do all that human care, vigilance, and foresight reasonably can do under the circumstances to avoid harm to passengers [or property].”
Any person that is injured in a truck accident may have the ability to file a claim for damages. Determining liability in an accident that involves multiple vehicles can be difficult. Thankfully, most intersections are equipped with cameras and most trucks are equipped with event data recorders. A truck accident attorney can investigate your claim free of charge and let you know what your options are.
