Surjit Basra Lodi: One Person Identified As Surjit Kaur Basra Has Died In Ammonia Gas Leak Accident At Cherry Packing Company Identified As Delta Packing Co; Another Six Salinas Farm Labor Contractor Employees Injured

STOCKTON, CALIFORNIA (May 17, 2019) – A worker identified as Surjit Kaur Basra has tragically died in a ammonia gas leak accident at Lodi cherry packing facility owned by Delta Packing Co.

A total of six Salinas Farm Labor contractor employees had to be hospitalized after the ammonia leak. Cal/OSHA officials are saying that an ambulance was called after the first employee started to become sick.

The identity of the female employee that died has been confirmed to be Surjit Kaur Basra.  An investigation into the Delta Packing Co accident remains ongoing.

Ammonia is a compound made up of hydrogen and nitrogen and is completely colorless. It is corrosive to the eyes, skin and lungs and can be lethal in high quantities.

Liability In Workplace Accidents

There are a number of laws designed to protect workers. Every company is supposed to take measures to make sure that workers are protected from obvious hazards. When a worker is injured or dies on the job, their employer is supposed to help take care of them through the workers compensation system. According to the California Department of Industrial Relations Workers Compensation Guidebook, “If you get hurt on the job, your employer is required by law to pay for workers’ compensation benefits.”

Depending on the facts of any case the worker’s compensation system may not be the only form of support for a worker or their family. An injured worker or their family may have the ability to file a third party liability claim. A third party liability claim may be possible if an entity separate from a worker’s employer contributed to an accident. Sources of potential negligence in a gas leak may include:

  • Damaged service lines
  • Damaged underground pipelines
  • Faulty equipment or pipeing
  • Faulty gas detectors

The family of a worker that died in a gas leak accident may be able to seek justice through California Code of Civil Procedure 377.60. Damages can help cover funeral expenses, lost wages and loss of love. A wrongful death attorney can examine all of the facts of your case and let you know what your options are. There are statute of limitations associated with pursuing a claim, so it’s important to be proactive.
