Teenage Girls Injured In Stanislaus County Boat Accident After Their Jet Ski Was Hit By Drunk Boater On Modesto Reservoir

STANISLAUS COUNTY, CALIFORNIA (June 23, 2019) – Two teenage girls were seriously injured in a jet ski accident after they were hit by a drunk boater on the Modesto Reservoir.

Around 5:00 p.m. on Saturday the two girls were on a jet ski in the Modesto Reservoir. They were hit by a boater who was later arrested on suspicion of DUI.

The 15-year-old girl was taken to the hospital in critical condition and the 14-year-old sustained multiple broken bones in the accident.

A full investigation into the boat accident on the Modesto Reservoir remains ongoing at this time.

Liability In Boat Accidents

According to ScuttleButt, “In 2015, the Coast Guard counted 4,158 accidents that involved 626 deaths, 2,613 injuries and approximately $42 million dollars of damage to property as a result of recreational boating accidents.” Contrary to what some people think, there are right-of-way rules that boaters must follow in order to prevent accidents.

  • Every vessel must maintain a look out for other boats and pedestrians at all times
  • Every vessel must proceed at a safe speed at all times.
  • Boaters must steer clear of navy vessels
  • Faster moving vessels (speedboats) must yield the right of way to slower moving vessels (rowboats)

Unfortunately, many boaters choose to break the law and operate their vessels while intoxicated. According to California Vehicle Code 23152, “(a) It is unlawful for a person who is under the influence of any alcoholic beverage to drive a vehicle. (b) It is unlawful for a person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle.” Boaters that operate their vehicles under the influence may face civil as well as criminal liability.

Any person that is injured in a boat accident may have legal recourse through a bodily injury claim. Damages in a civil claim may include compensation for lost wages, medical bills and pain and suffering. A personal injury attorney can investigate all of the facts of your case and let you know what your legal options are. There are, however, statute of limitations associated with being able to file a claim, so it’s important to act quickly.
