Spring Valley Highland Elementary School Bus Accident: Multiple Children Injured In School Bus Accident After Driver Braked Hard To Avoid Truck On Helix Street

SPRING VALLEY, CALIFORNIA (March 4, 2019) – Multiple Highland Elementary School students were injured in a school bus accident after they were thrown forward following a near collision with a truck on Helix Street.

Spring Valley authorities are saying that a truck pulled out in front of the bus on Helix Street. The school bus driver immediately applied their brakes which caused multiple children to hit the seats in front of them.

Four of the nine Highland Elementary School students complained of pain following the accident. Three students in total were taken to the Sharp Grossmont Hospital in order to receive treatment for their injuries.

San Diego police are still investigating the source of the accident. Both the school bus driver and the truck driver are cooperating with investigators.

Liability In School Bus Accidents

There may be multiple sources of liability for a school bus accident involving a truck. For example, a truck driver could be responsible for making an unsafe lane change prior to an accident. According to California Vehicle Code 22107, “No person shall turn a vehicle from a direct course or move right or left upon a roadway until such movement can be made with reasonable safety and then only after the giving of an appropriate signal in the manner provided in this chapter in the event any other vehicle may be affected by the movement.”

There may also be liability on the part of a bus driver. School buses are considered “common carriers” and must exercise the utmost caution in order to avoid accidents. According to the Judicial Council of California Civil Jury Instructions, “Common carriers must carry passengers [or property] safely. Common carriers must use the highest care and the vigilance of a very cautious person. They must do all that human care, vigilance, and foresight reasonably can do under the circumstances to avoid harm to passengers[or property].”

Victims of school bus accidents may be able to seek damages for their lost wages, medical bills and pain and suffering. Many victims may not even realize the full extent of their injuries until several days or weeks later. Some early symptoms of injuries from a bus accident may include:

  • Headaches
  • Neck or shoulder pain
  • Back pain
  • Abdominal pain
  • Numbness
  • Changes in personality

A bus accident attorney can investigate all of the facts of your case and let you know what your options are. There are statute of limitations associated with being able to pursue a claim so it’s important to act quickly.
