One of the beams that was placed came into contact with another stack of beams. A beam fell from the stack and struck Gregorio Segundo in the head. Firefighters and paramedics rushed to the scene in order to give him treatment.

Cal/OSHA is conducting an investigation in order to determine if there were any workplace violations and to see what went wrong. West Coast Iron, inc. is a full service steel company that is located in Spring Valley.

Preventing Accidents At Construction Sites

The accident at West Coast Iron that led to the death of Gregorio Segundo is deeply unfortunate. There are safety procedures in place designed to prevent incidents like this. According to the Occupational Safety and Health Administration (OSHA), there are four major types of accidents that account for the disproportionate number of workplace injuries and deaths. OSHA has listed these accidents as the “fatal four.” Here are the four major causes of construction accidents and how you can help prevent them:

  • Falls: Falls are the leading cause of injury and death at construction sites. There are a number of measures that OSHA has cited that can help keep workers safe. Workers that are more than 6 feet off the ground should use fall protection arrest systems. Even if a worker does fall they will be caught. Perimeter protection equipment should be installed and maintained. Floor openings should be securely covered.

  • Struck By Object: Related to falling accidents, a number of workers are killed or seriously injured when they are struck by an object that has fallen. Workers can also be struck by vehicles. In order to prevent these types of accidents workers should wear high visibility clothing and not put themself in between moving objects.

  • Caught-In/Between: In many cases a worker can be killed or seriously injured when they become caught by heavy machinery or trapped in a trench. Trenches should be protected by shielding systems. The proper lock-in/out methods should be used around heavy machines.

  • Electrocutions: Even a small electrical wire can deliver a lethal amount of electricity to a person. The wire may even electrify a larger surface or body of water. Utilities should be located before workers start their job. Ground-fault circuit interrupters can also be used for protection.

Workplace accidents at construction sites can leave workers with debilitating injuries and often prevents them from going back to work. A number of workers are also killed every year. A wrongful death attorney familiar with construction site accidents can investigate your claim and take steps to help preserve your rights.

Liability In Construction Accidents

As Cal/OSHA investigators are examining the construction accident that led to the death of Gregorio Segundo there are a number of factors that they will want to consider. For example, were any workplace violations made? Has there been a history of accidents at West Coast Iron? Generally speaking, workers in California are barred by statute from bringing claims against their employer. But an injured worker or their family may have the ability to file a workers compensation claim for damages including lost wages. In addition to worker’s compensation there may also be third party negligence allowing a family to file a personal injury claim. For example, industrial sites will typically require multiple companies to work together. If an employee from a separate company injures a worker that may give rise to a third party claim. It’s always a good idea to seek the experienced legal counsel of an attorney after an accident. They can investigate all of the specific elements of your case and let you know what your rights are.
