39-Year-Old Woman Injured In Electric Bicycle Accident In South Lake Tahoe After Falling From Sidewalk In Front Of The Grocery Outlet Store

SOUTH LAKE TAHOE, CALIFORNIA (June 3, 2019) – A 39-year-old woman was seriously injured after falling from her electric bicycle and being run over by a car near the Grocery Outlet Store.

The victim apparently lost control of her bicycle after hitting loose gravel on the sidewalk. The woman proceeded to fall off of her bicycle and her leg was run over by a car.

An off-duty nurse from Barton Health saw the accident and stopped in order to help the victim. Paramedics and emergency responders then arrived at the scene in order to transport her to the hospital.

Authorities are saying that the victim was complaining about pelvic pain before she was transported to Barton Hospital. The driver that ran her over remained at the scene and cooperated with police.

Liability In Bicycle Accidents

Drivers have a legal responsibility to look out for bicyclists and do their best to avoid accidents. According to California Vehicle Code 21200, “A person riding a bicycle or operating a pedicab upon a highway has all the rights and is subject to all the provisions applicable to the driver of a vehicle by this division.” But many accidents are not caused 100% due to the negligence of other drivers.

A city or company may face civil liability for an accident if it was caused by a defect on their property. According to the California Civil Code § 1714 subsection (a), “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.” For example, a sidewalk could be in a dangerous condition if it was covered with gravel or had cracks which could cause someone to trip.

Any person that is injured in a bicycle accident may have legal recourse through a bodily injury claim. Damages can include money for lost wages, medical bills and pain and suffering. Even a mild injury from a bicycle accident can cost well over $35,000. This can be a crushing burden for both individuals and families. A bicycle accident attorney can examine all of the facts of your case and let you know what your legal options are.
