Linda Cosgrove Sonora: 67-Year-Old Woman Identified As Linda Cosgrove Injured In Car Accident In Front Of Wells Fargo ATM At Junction Shopping Center
SONORA, CALIFORNIA (March 7, 2019) – A 67-year-old woman identified as Linda Cosgrove was injured in a parking lot accident near a Wells Fargo ATM at the Junction Shopping Center.
Linda Cosgrove was standing in front of the ATM when a 73-year-old woman attempted to pull into a parking spot. The driver pulled onto the curb and struck the victim from behind with her 2005 Kia Optima.
The victim was taken to a hospital in Modesto in order to receive treatment. It remains unclear if weather may have contributed to the crash, but it was wet and cloudy when the victim was hit.
Neither drugs nor alcohol are believe to have played a role in the crash. An investigation into the cause of the accident remains ongoing at this time.
Liability In Parking Lot Accidents
On average there are over 50,000 parking lot accidents every year causing some 60,000 injuries. According to the National Safety Council, “two-thirds of drivers may be pulling into shopping centers distracted.” Drivers are typically to blame for these accidents. A driver may be intoxicated, distracted or speeding. A number of elderly drivers experience “pedal confusion” and cause accidents in parking lots. In short, an older driver may confuse the accelerator for the brakes.
In addition to driver negligence, there may also be negligence on the part of a property owner if an accident was caused by a dangerous condition on the property. According to the California Civil Code § 1714 subsection (a), “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.”
A parking lot may be in a dangerous condition if it lacks adequate signage or is poorly lit. A premises liability attorney can examine all of the facts of your case and let you know what your rights are. An attorney can make sure that your rights are being protected and that you are properly compensated for all of your injuries. There are, however, statute of limitations associated with being able to pursue a claim.
