Lucy Barrera Sonoma, Miriam Nolazzo Sonoma, Martin Arias Barajas Sonoma, Maria Celina Barajas Sonoma: Six People Injured In Head-On Car Accident With Owner Ty Caton Vineyards On Broadway
SONOMA, CALIFORNIA (January 15, 2019) – Five people in a 2013 Chevrolet Captiva SUV identified as Lucy Barrera, Miriam Nolazzo, Martin Arias Barajas and Maria Celina Barajas were injured when they were hit head-on by the owner of Ty Caton Vineyards.
Sonoma authorities are saying that the proprietor and winemaker was operating a Range Rover when he allowed his vehicle to drift into opposing lanes of traffic on Broadway. The Range Rover hit the Chevrolet SUV head-on trapping numerous occupants inside.
Firefighters had to cut away parts of the Chevy SUV in order to free Lucy Barrera, Miriam Nolazzo, Martin Arias Barajas and Maria Celina Barajas. According to the Sonoma Index Tribune, Martin Barajas was the most seriously injured and had to be transported to the Kaiser Hospital in Vacaville.
The other victims were taken to the Queen of the Valley Hospital in Napa. All of those involved were thankfully wearing seat-belts. One witness described seeing the Range Rover crossing over the double yellow line. “I’ve never seen anything like that,” said Charlotte Galloway. “I just saw his headlights drift into the oncoming lane.”
Investigators are still working to determine what happened.
Liability In Car Accidents
It is illegal to cross a double yellow line, though a number of drivers do this to pass other vehicles. According to the California Vehicle Code (VC) § 21460, “If double parallel solid yellow lines are in place, a person driving a vehicle shall not drive to the left of the lines, except as permitted in this section.” Crossing a double yellow line and causing an accident will impose civil liability on the negligent driver. If any person is injured in the accident they will be able to pursue a claim for damages. These damages may include compensation for medical bills, lost wages and pain and suffering.
If the negligent driver was working on behalf of a company, that may expose the company that they work for to civil liability as well. Vicarious liability is one of the core concepts in personal injury law. Generally speaking, a company can only be held vicariously liable for an employee’s negligence when that employee was working within the course and scope of their job duties. For example, if a driver was transporting goods from one location to another this might be within the scope of their duties. A car accident attorney can investigate your claim and help maximize the compensation following an accident.
