Jason Clar Sonoma County: 42-Year-Old Man Identified As Jason Clar Seriously Injured In E-cigarette Explosion Accident
SONOMA COUNTY, CALIFORNIA (April 29, 2019) – A Sonoma County construction worker identified as Jason Clar was seriously injured when an e-cigarette battery exploded in his pocket.
Jason Clar was wearing thick construction pants at the time of the accident. The explosion ripped a hole in those pants and caused serious damage to the back of his leg.
He was rushed to the emergency room in order to receive skin grafts. Jason Clar told reporters that he is inconstant pain and not sure when he will be able to work or ride his motorcycle again.
An investigation into the cause of the accident that injured the construction worker remains ongoing at this point.
What Causes E-cigarette Batteries To Explode
According to data released by the Food and Drug Administration, there have been an estimated 2,035 people hospitalized in e-cigarette explosions from 2015-2017. A number of people have died from their injuries. Based on another report from the (FDA), “The exact causes of such incidents are not yet clear, but some evidence suggests that battery-related issues may lead to vape explosions.” While the FDA has not endorsed “vaping,” they have put forward suggestions on how to smoke these devises safely.
The New England Journal of Medicine says that e-cigarettes remain largely unregulated. Victims of e-cigarette explosions may receive a wide variety of injuries including:
- Flame burns (80%)
- Chemical burns (33%)
- Blast injuries (27%)
Other victims have lost eyes, teeth and in many cases died. Burn injuries are among the most painful types of injuries that a person can receive. Treatment typically includes multiple costly and painful skin grafts. As the number of injuries from e-cigarette explosions has increased so to has the number of lawsuits. Depending on the facts of any case, there may be multiple sources of liability for an e-cigarette explosion.
Liability In E-cigarette Explosion Accidents
Most lawsuits involving an e-cigarette explosion will be pursued as product liability claims. According to Soule v. GM Corp, “A manufacturer, distributor, or retailer is liable in tort if a defect in the manufacture or design of its product causes injury while the product is being used in a reasonably foreseeable way.” Generally speaking, product liability claims fall into one of three categories:
- Design Defects – occurs when a product is inherently unsafe for use.
- Manufacturing Defects – occurs when there is a flaw in how a product is assembled.
- Marketing Defects – occurs when a product is improperly labeled or otherwise has insufficient warnings.
A product liability claim could be pursued against e-cigarette manufacturers under any of these theories. Many consumer safety advocates have spoken out against these devices because the public has not been sufficiently warned to the dangers. A number of explosions take place when the positive terminal of the battery is exposing to the negative terminal.
Any person that is injured in an e-cigarette explosion accident may have legal recourse through a bodily injury claim. Victims may be able to receive damages for lost wages, medical bills and pain and suffering. A personal injury attorney can investigate all aspects of your case and let you know what your options are. It doesn’t cost anything to hire an attorney and they only get paid if they successfully resolve your case. There are statute of limitations associated with being able to file a claim, so it’s important to act quickly.
