Liability In Car Accidents
Every driver has a legal responsibility to operate their vehicle in a reasonably safe manner according to the prevailing conditions of the road. According to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.”
Parking lots can be very dangerous places. This is why drivers are expected to travel slowly and keep an eye for pedestrians and other cars. When a driver is backing out of a parking spot they should check their mirrors and (if possible) backup camera. There is simply no excuse for a backup accident. If a driver is unsure what may be behind them they should get out and look.
The victim of a pedestrian accident may be able to recover damages through a bodily injury claim. Damages can include money for lost wages, medical bills and pain and suffering. A pedestrian accident attorney can examine all of the facts of your case and let you know what your legal options are. It doesn’t cost anything to hire an attorney and they only get paid if the successfully settle or win your case.
