Liability In Truck Accidents In The United States
There are a number of state and federal regulations regarding how a truck driver must operate their vehicle. Like everyone else, truck drivers should drive according to the prevailing conditions of the road. According to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.” Driving the speed limit during a rainstorm or decreased visibility may very well be reckless.
In the United States, trucking companies are considered “common carriers.” A common carrier is any company that transports people or goods for money. Their drivers are held to a higher standard of care and must utilize the vigilance of a “very cautious person.” Based on the court case Squaw Valley Ski Corporation v. Superior Court, “The elevated standard of care for common carriers is “based on a recognition that the privilege of serving the public as a common carrier necessarily entails great responsibility, requiring common carriers to exercise a high duty of care towards their customers.””
Victims of truck accidents can often suffer serious and long lasting injuries. Many of the injuries may not be evident until many months or even years following an accident. Some of the injuries are even invisible to the naked eye. According to a research paper by Gayle Beck and Scott Coffey, “Individuals who experience a serious motor vehicle accident (MVA) are at increased risk for psychological problems, particularly Posttraumatic Stress Disorder (PTSD).” The severity of any psychological injuries tends to go up with the presence of brain trauma.
Any person that is injured in a truck accident will have the ability to hold the truck driver responsible through a bodily injury claim. Damages in a bodily injury claim can include money for medical care, lost wages and psychological trauma. A truck accident attorney can evaluate your case free of charge and let you know what your rights are. Personal injury attorneys in the United States work on a contingency fee basis. They don’t get paid unless they win or settle your case.
