Liability In Pedestrian Accidents
Drivers have a common law duty to exercise care when driving and take steps to avoid hitting pedestrians. According to
California Vehicle Code §21950, “The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection. The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.”
A number of pedestrian accidents take place every year when drivers are simply not paying attention. Teenage drivers in particular are statistically much more likely to cause car accidents than older drivers. According to the Centers for Disease Control, motor vehicle accidents are the leading cause of death for people aged 15 – 19. Victims of car accidents are protected by a number of laws. The family members of a person that died will be able to file a wrongful death claim for damages. A pedestrian accident attorney can investigate the specific facts of your case and let you know if you have a claim that can be pursued.
