Liability In Car Accidents
According to the FMCSA, around 35,000 people are killed every year in car accidents. Fatigue, speeding and alcohol use are among the leading factors of deadly accidents. All drivers are expected to use caution and operate their vehicles according to the prevailing conditions of the roadway. According to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.”
The family of a worker that died on the job will have numerous options following an accident. According to the California Worker’s Compensation Guidebook, employers in California have a responsibility to purchase worker’s compensation insurance. Death benefits are supposed to be given to a worker’s spouse, children or other dependents in the event that they are killed on the job. Family members of the victim may also be able to pursue a third party liability claim against any negligent driver.
