Liability In Pedestrian Accidents
Around 4,000 pedestrians are killed in accidents every year. The vast majority of accidents take place in the early morning hours and 6:00 p.m. to 9:00 p.m. Drivers are often more fatigued during this time and thus more likely to hit pedestrians. According to the California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.”
The family of a victim that died in a pedestrian accident may have the ability to pursue a wrongful death claim. This can help a victim’s next of kin recover damages for lost wages, funeral expenses and loss of love. A wrongful death attorney can examine all of the unique facts of your case and get to the bottom of what happened.
