Liability In Drunk Driving Accidents
According to the Centers For Disease Control, “Every day, 29 people in the United States die in motor vehicle crashes that involve an alcohol-impaired driver. This is one death every 50 minutes. The annual cost of alcohol-related crashes totals more than $44 billion. Drugs other than alcohol (legal and illegal) are involved in about 16% of motor vehicle crashes.” Here are just a few of the ways in which a BAC of just 0.05% can impair a person’s driving:
- May have loss of small-muscle control (e.g., focusing your eyes)
- Impaired judgment
- Lowered alertness
- Reduced coordination
- Reduced ability to track moving objects
- Difficulty steering
- Reduced response to emergency driving situations
Drivers that cause accidents resulting in injury while under the influence of alcohol or drugs may face civil as well as criminal liability. According to California Vehicle Code 23152, “It is unlawful for a person who is addicted to the use of any drug to drive a vehicle. It is unlawful for a person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle.” Victims of DUI car accidents are protected by a number of laws.
If a victim was working at the time of an accident they will typically have access to worker’s compensation. According to the California Department of Industrial Relations Workers Compensation Guidebook, “If you get hurt on the job, your employer is required by law to pay for workers’ compensation benefits.” They may also be able to hold an intoxicated driver legally responsible through a civil claim.
Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Very often a victim may not even realize the full extent of their injuries until several weeks or months later. It’s important to seek treatment as quickly as possible after an accident. The smart thing to do after that is to contact an experienced car accident attorney. An attorney can evaluate all of the facts of your case free of cost and let you know what your legal rights are.
